A quick but important note on superannuation
Engaging someone as an independent contractor or subcontractor does not automatically mean you’re off the hook for superannuation.
In some situations, particularly where the individual is paid mainly for their labour, you may still be legally required to pay super, even if:
- they have an ABN, and
- you’re calling them a contractor or subcontractor.
This is a common trap for growing businesses and one of the most expensive mistakes we see. These agreements help you clearly define the relationship, but you should still assess your super obligations separately and apply the ATO tests to each engagement.
(In other words: the paperwork matters, but so does how the arrangement works in practice.)
