Hiring contractors doesn’t mean cutting legal corners. The Contractor Only Bundle gives you the essential legal documents and practical tools you need to engage independent contractors and subcontractors correctly, without the confusion.

This bundle includes an Independent Contractor Agreement, Subcontractor Agreement, plus practical non-contract assets like a Contractor Onboarding Checklist and Contractor Exit Checklist. Designed by lawyers and made for business owners, this bundle helps you protect your business, clearly define working relationships, and stay compliant while scaling with contractors.

The Contractor Only Bundle is designed for businesses that engage independent contractors and/or subcontractors and want those relationships set up properly, clearly, and legally

While these terms are often used interchangeably, they serve very different purposes, and using the wrong agreement is one of the fastest ways to create legal, tax, and compliance headaches.

This bundle includes both agreements, so you can confidently engage the right type of contractor for the right situation.

What’s the difference?

Independent Contractors

Typically used when you’re engaging support roles or ongoing assistance in your business, such as:

  • Virtual assistants
  • Admin or operations support
  • Bookkeepers
  • Marketing or social media support

They support your business operations but are not employees.

Subcontractors

Used when:

  • You have too much client work on
  • You want to offer a specialised service you don’t provide in-house
  • You’re delivering work to your client using another professional

For example:

  • A designer hiring a developer for a client project
  • A photographer outsourcing editing
  • An agency bringing in a specialist for a specific deliverable

Subcontractors are engaged to help you deliver your services, not run your business.

Why this matters

Using the wrong agreement (or no agreement at all) can expose you to:

  • Contractor misclassification risks
  • Superannuation and tax issues
  • IP ownership disputes
  • Client delivery and liability problems

This bundle removes the guesswork.

With lawyer-drafted agreements plus practical onboarding and exit checklists, you’ll have everything you need to engage contractors correctly from start to finish, without dodgy downloads or cobbled-together contracts.

Solid legal foundations. Clear roles. Fewer risks.

A quick but important note on superannuation

Engaging someone as an independent contractor or subcontractor does not automatically mean you’re off the hook for superannuation

In some situations, particularly where the individual is paid mainly for their labour, you may still be legally required to pay super, even if:

  • they have an ABN, and
  • you’re calling them a contractor or subcontractor.

This is a common trap for growing businesses and one of the most expensive mistakes we see. These agreements help you clearly define the relationship, but you should still assess your super obligations separately and apply the ATO tests to each engagement.

(In other words: the paperwork matters, but so does how the arrangement works in practice.)

IMPORTANT

Purchasing our fill in your blanks templates for you to customise and ensure they suit you and your business needs, utilising our free resources or having a chat with us as part of a consultation doesn’t create a lawyer-client relationship between you and Foundd Legal (sorry!). It also doesn’t constitute legal advice. Please consult with a lawyer for any questions.

We do offer templates for countries outside of Australia, you will see on the specific template page which country or countries the template is available for, just make your selection! Unfortunately at this time, we are only offering templates for the countries specified.

Our templates are however customisable for countries outside of Australia, and whilst they are a good base and potentially save you money getting something created from scratch, it would be prudent to have a lawyer in your country to review the template especially if you have any questions.

You get a single user licence and can re-use the templates you purchase as many times as you want for your own business needs! But keep in mind we’re a small business just like you, offering a service and we need more people like you to help us continue to grow - just like you! So from the bottom of our humble hearts, thank you for making a legit purchase and not sharing! Use of this Site and your purchase of any digital products or downloading of any free resources, are subject to our Terms and Conditions.

Yes. Your purchase includes a single user licence allowing reuse for your own business as often as needed.

These templates are designed to clearly define whether someone is engaged as an independent contractor or a subcontractor, which helps reduce the risk of misclassification when the agreement is used correctly and reflects how the relationship operates in practice.

However, misclassification risk doesn’t come from paperwork alone. It also depends on factors like:

- how much control you have over the person

- whether they can subcontract their work

- how they’re paid

- how integrated they are into your business.

These templates give you a strong legal framework, but you still need to ensure your day-to-day arrangements align with the agreement.

(In short: the contract helps, but behaviour matters too.)
